General Terms and Conditions (GTC)
1. Scope
Beluga Kids is a company of UNIQ Marketing & Retail GmbH, based in Egg near Zurich (hereinafter “Beluga Kids”), and operates an online shop for baby and children's products. These General Terms and Conditions apply to all orders placed on the websites https://belugakids.ch, https://belugakids.shop, https://belugakids.de in the version valid at the time of the order. Swiss law shall apply exclusively, to the exclusion of any conflict of law provisions.
2. Orders and Conclusion of Contract
By placing an online order, you agree to these GTC. The contract is concluded by clicking the “BUY” button and receiving the order confirmation by email. This creates a legally binding purchase contract.
3. Delivery and Sales Conditions
After receipt of the order confirmation, the ordered items will be shipped as a parcel to the delivery address provided.
The logistics processing (in particular storage, picking, packing and shipping) is carried out in whole or in part by Stiftung ESPAS, Naglerwiesenstrasse 4, 8049 Zurich, as an appointed third-party service provider (3PL). Responsibility for the sale and the contractual relationship with the customer remains exclusively with Beluga Kids. Beluga Kids is responsible for the careful selection and instruction of the appointed service provider.
Unless otherwise stated under “delivery time”, the standard delivery time is 2–4 working days, and 1–2 working days for priority shipping (for orders placed before 12 noon). The delivery conditions of Swiss Post apply.
For international orders, delivery time may be extended by up to 15 working days.
If delivery fails after two attempts, we are entitled to withdraw from the contract. In this case, any shipping and return costs shall be borne by the buyer.
13. Right of Withdrawal / Returns
Under Swiss law (Code of Obligations), there is no statutory right of withdrawal. Beluga Kids therefore offers a voluntary return policy of 14 days from receipt of the goods.
13.1 Return Costs
Returns are generally at the buyer’s expense. For orders within Switzerland, a return label is provided via the customer account for a reduced fee of CHF 5.90. Beluga Kids reserves the right to refuse this service.
13.2 Return Process
Returns must be clearly identifiable based on sender information to allow for a refund.
13.3 Restocking Fee
For returns outside the 14-day period or for items not returned in proper condition, we reserve the right to charge a restocking fee of 20% of the item value or to refuse the return. In certain cases, a flat fee may be charged if return conditions are not met.
13.4 Condition of Goods
Items must be unused, unworn, undamaged and returned in their original packaging including product labels.
13.5 Deduction of Shipping Costs
For orders below CHF 120.00, the original shipping costs (CHF 7.90) will be deducted from the refund.
13.6 Exceptions
Returns are excluded for bulky goods, furniture, hygiene products, sale items, second season items and Give-A-Chance (second choice) products.
13.7 Refund Options
In case of withdrawal, you may choose between a store credit or a refund of the purchase amount (minus shipping costs and any applicable restocking fee).
17. Data Protection
The protection of your personal data is very important to us. We comply with applicable data protection laws, in particular the revised Swiss Data Protection Act (revDSG), and protect your data against unauthorized access.
Our online shop uses SSL (Secure Socket Layer) encryption to ensure secure transmission of all data.
To process orders, we work with external service providers (in particular logistics partners such as Stiftung ESPAS, Naglerwiesenstrasse 4, 8049 Zurich). In this context, the personal data required for contract fulfilment (e.g. name, delivery address, contact details, order information) is shared with these third parties. This data transfer is carried out exclusively for the purpose of contract fulfilment in accordance with Art. 31 revDSG. These service providers are contractually obliged to process the data only within the scope of their services, in accordance with our instructions and applicable data protection laws.
Beluga Kids may use your personal data to send you special offers or information about new collections. You may withdraw your consent at any time by email.
We protect our website and systems through technical and organisational measures. Access to your customer account is only possible with your personal password.
This website contains Facebook, Instagram and Pinterest buttons. By activating them, you interact directly with these platforms. These providers may process personal data in ways that are not fully transparent. Beluga Kids is not liable for any misuse of personal data by these platforms.
